JKWEEN MICROCARE FOUNDATION | LendPe Mobile Application Effective as of: [20-07-2025]
These Terms and Conditions (“Terms”) are issued by JKWEEN MICROCARE FOUNDATION (“JKWEEN,” “we,” “us,” or “our”), a not-for-profit microfinance institution licensed under Section 8 of the Companies Act, 2013 and located at 57/6, 18th A Cross, Egipura, Bangalore North, Karnataka, India, 560047, India. By accessing, registering, or using the LendPe mobile application (“LendPe App” or “App”) or any associated service (“Service”), you (“User” or “Applicant”) affirm your agreement to these Terms, which shall govern all interactions between you and JKWEEN regarding loan products and digital services on LendPe.
PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE PROCEEDING. YOUR ACTION OF CLICKING “SUBMIT,” VERIFYING YOURSELF VIA A ONE-TIME PASSWORD (“OTP”), OR OTHERWISE ENGAGING WITH THE LENDPE APP SHALL CONSTITUTE FULL AND IRREVOCABLE ACCEPTANCE OF THIS CONTRACT. IF YOU DO NOT AGREE, PLEASE REFRAIN FROM USING THE SERVICE.
1. User Declaration and Eligibility
1.1 By signing up or submitting loan requests on LendPe, you represent and confirm that:
- You are at least eighteen years of age, fit to contract as per Indian law.
- You are fully competent to understand, read, and communicate in English.
- All statements, declarations, and entries made by you during onboarding or subsequently are, to your best knowledge, accurate and truthful.
1.2 Any misrepresentation or breach of this section may result in immediate suspension, cancellation of your application, and potential legal consequences.
2. Acceptance and Digital Execution
2.1 The completion of in-app verification steps (such as OTP entry and “Submit” confirmation) shall be regarded as your electronic signature, evidencing your informed, express, and binding consent to the entirety of these Terms.
2.2 This digital endorsement holds the same force and validity as a manually signed document, establishing a legally enforceable agreement with JKWEEN.
3. Obligations and Accuracy of Information
3.1 All data, supporting documents, or profiles you provide must be precise, complete, and the latest.
3.2 You are obliged to promptly inform JKWEEN of any modification or update relevant to your contact details, repayment ability, or other submitted particulars.
4. Loan Offer, Sanction, and Repayment
4.1 JKWEEN possesses absolute discretionary authority to review, approve, or decline any loan application at any stage, without the need to justify such decision.
4.2 Should your application succeed, you agree:
- To abide by the designated loan tenure and repayment scheme (biweekly, or monthly, as elected).
- That all EMI payments, principal, and charges shall be settled within the schedules set out in your loan agreement or as communicated through the App.
- Late payments or missed installments may result in additional charges, adverse credit records, or recovery measures as permitted by law.
5. Authorization for Data Processing
5.1 By registering with LendPe, you unequivocally grant permission for JKWEEN and its appointed affiliates to:
- Retrieve, validate, analyze, and store your KYC, identity proofs, financial records, and behavioral data.
- Share and cross-verify your profile and credit actions with regulatory bodies, credit rating bureaus, partner financial institutions, audit consultants, and law enforcement, strictly for purposes of credit assessment, servicing, compliance, portfolio management, and statutory reporting.
5.2 JKWEEN respects your privacy and shall use and share your data only as legally permissible, ensuring confidentiality and safeguarding against unauthorized access.
6. Consent to Communication
6.1 You expressly agree that JKWEEN, or its designated representatives, may reach out to you for any lawful purpose—including but not limited to application processing, loan reminders, notifications, marketing, and customer service—through email, SMS, telephone, app notifications, or any other appropriate electronic or physical channel.
6.2 If you fail to respond or default on your obligations, you consent that JKWEEN may contact referees, professional connections, or numbers from your provided contacts, exclusively for recovery or verification purposes.
7. Credit and Background Verification
You hereby authorize JKWEEN and its authorized agents to conduct or commission detailed background, employment, and financial verifications, including but not limited to credit bureau (e.g., CIBIL), PAN, and employer checks, as deemed fit for assessing or managing your loans and ongoing risk profile.
8. Non-Liability and Limitation
8.1 JKWEEN shall not be accountable for denial of service, technological interruptions, financial losses, or liability arising from inaccuracies in user-submitted data, third-party service outages, or matters outside JKWEEN’s reasonable control.
8.2 Your usage of LendPe services is entirely at your own initiative and risk. You agree to indemnify and defend JKWEEN, including its officers and associates, from any claim, penalty, or demand arising from breach of these Terms or willful misrepresentation.
9. Termination
JKWEEN may terminate or restrict your access to the App or any Service without prior notice for violations of these Terms, suspected fraud, regulatory requests, or risks to the institution or other users.
10. Modifications
JKWEEN reserves the right, in its sole discretion, to amend, update, or replace these Terms at any time. Major revisions will be posted within the LendPe App or on the official website; continued use constitutes acceptance of such modifications.

12. Governing Law and Jurisdiction
These Terms shall be governed and construed in line with the laws of India. All matters of dispute shall be subject to the exclusive jurisdiction of competent courts situated in Bengaluru, Karnataka.
BY PROCEEDING, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND FREELY AGREED TO ALL TERMS STATED HEREIN, AND THAT YOUR ACTIONS CONSTITUTE LAWFUL AND IRREVOCABLE ACCEPTANCE AND EXECUTION OF THIS AGREEMENT.
